DMCA Policy
This Digital Millennium Copyright Act (“DMCA”) Policy explains how Nathaniell responds to claims of copyright infringement in accordance with the United States Digital Millennium Copyright Act, 17 U.S.C. § 512.
Nathaniell respects the intellectual property rights of others and expects users, partners, and third parties to do the same. This policy applies to all content, materials, and products made available through our website.
1. Copyright Protection Commitment
Nathaniell is committed to complying with applicable copyright laws and regulations. All website content is published in good faith and is believed to be either owned by Nathaniell, licensed for use, or permitted under applicable law.
We take copyright infringement claims seriously and will respond promptly to valid notices submitted in accordance with the DMCA.
2. Scope of This DMCA Policy
This DMCA Policy applies to all copyrighted materials displayed on the Nathaniell website, including but not limited to:
- Website text, articles, and descriptions
- Product images, photographs, and graphics
- Design elements, layouts, and visual content
- Logos, branding materials, and trademarks
Unauthorized reproduction, distribution, or use of copyrighted material without permission is strictly prohibited.
3. Filing a DMCA Takedown Notice
If you believe that material available on the Nathaniell website infringes your copyright, you may submit a written DMCA takedown notice. All notices must be submitted in good faith and include sufficient detail to allow us to identify and evaluate the claim.
A valid DMCA notice must clearly identify the copyrighted work, the allegedly infringing material, and include a statement of ownership or authorization to act on behalf of the copyright owner.
Incomplete or inaccurate notices may not be processed.
4. Required Information in a DMCA Notice
To be effective under the DMCA, a takedown notice must include the following:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing
- Information sufficient to locate the material on our website
- A statement that the claim is made in good faith
- A statement, under penalty of perjury, that the information is accurate
Notices that fail to meet these requirements may be rejected.
5. Review and Takedown Process
Upon receipt of a valid DMCA notice, Nathaniell will conduct an internal review to assess the claim. If the claim appears valid, the allegedly infringing material may be removed or disabled without prior notice.
Temporary removal does not constitute an admission of infringement and is performed solely to comply with DMCA requirements.
6. Counter-Notification Process
If you believe that material removed under a DMCA takedown notice was removed in error or misidentification, you may submit a counter-notification.
A valid counter-notification must include a statement asserting lawful use of the material and consent to jurisdiction as required by the DMCA.
Submitting a counter-notification may result in legal proceedings if the original claimant disputes your claim.
7. Repeat Infringer Policy
In accordance with the DMCA, Nathaniell reserves the right to terminate access to the website or services for users who are determined to be repeat copyright infringers.
Determinations are made at Nathaniell’s discretion based on available information and applicable laws.
8. False or Abusive Claims
Submitting false, misleading, or abusive DMCA notices or counter-notices may result in legal liability. Nathaniell reserves the right to reject claims that appear to be fraudulent or submitted in bad faith.
Claimants are encouraged to seek legal advice before submitting a notice.
9. Limitation of Liability
To the fullest extent permitted by law, Nathaniell shall not be liable for damages arising from the removal or restriction of content under this DMCA Policy, provided such actions are taken in good faith.
This includes any loss of revenue, data, or business opportunities resulting from DMCA enforcement actions.
10. Policy Updates
Nathaniell reserves the right to modify or update this DMCA Policy at any time without prior notice. Changes will take effect immediately upon publication on the website.
Continued use of the website constitutes acceptance of the updated policy.
